Welcome to Fundathon. By creating an account, creating a board, or backing a fundraiser, you agree to these Terms. Please read them carefully.

1. Legal Operator

Fundathon is operated by Wallace In Wonderland Pty Ltd, an Australian company. References to "Fundathon", "we", "us", or "our" mean Wallace In Wonderland Pty Ltd.

2. The Service

Fundathon (the "Service") is a live fundraising platform that allows users ("Fundraisers") to create digital number boards and other users ("Supporters") to contribute to those boards by purchasing one or more numbers.

3. Eligibility

You must be at least 18 years old and legally capable of entering a binding contract to use the Service. By using Fundathon you confirm you meet these requirements.

Fundraisers are solely responsible for ensuring their campaigns comply with all applicable laws and regulations, including:

5. Supporter Contributions

When you contribute to a board, you do so to back the underlying cause. Any reward associated with the board is offered by the Fundraiser, not by Fundathon. Fundathon does not guarantee delivery of rewards.

6. Stripe Payments

Payments are processed securely through Stripe and other third-party providers. Your use of the payment service is subject to Stripe's terms. Fundathon does not store full card details. Funds are paid out to the Fundraiser's connected bank account on Stripe's standard payout schedule. Fundathon charges a platform fee disclosed at checkout.

7. Refunds

Donations are generally non-refundable. Refund requests are governed by our Refund Policy. Before payout expiry, refund requests should be directed to the fundraiser organiser. After payout, refunds become the responsibility of the fundraiser organiser.

8. Fraud Protection

Fundathon reserves the right to investigate campaigns and suspend accounts or payouts where fraudulent or suspicious activity is suspected. We may, at our sole discretion, reverse transactions, withhold payouts, or remove campaigns to protect supporters and the integrity of the platform.

9. Rewards Disclaimer

Rewards offered through Fundathon are intended as thank-you rewards and must comply with applicable laws and platform rules. Fundathon does not provide, fulfil, or guarantee any reward. See our Fundraiser Guidelines for what is and isn't permitted as a reward.

10. Gambling & Raffle Disclaimer

Fundathon is a fundraising platform and not a gambling platform. Any rewards, raffles, competitions, or prize-based activities run by a fundraiser must comply with applicable laws and regulations, including any state or territory permits or licences. Fundraisers are solely responsible for obtaining those approvals before launching a campaign.

11. Prohibited Conduct

You may not (a) create boards for illegal goods or services; (b) impersonate any person or entity; (c) attempt to interfere with the operation of the Service; (d) use automated means to access or scrape the Service; (e) use the Service to harass, threaten, or defraud others. 12. Intellectual Property

All Fundathon trademarks, logos, and original content are owned by Wallace In Wonderland Pty Ltd. You retain rights to content you post, but grant us a worldwide, royalty-free licence to display it as part of operating the Service.

13. Disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law, Fundathon disclaims all warranties, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

14. Limitation of Liability

To the maximum extent permitted by law, Fundathon's total liability arising out of or related to the Service shall not exceed the greater of (a) the fees paid by you to Fundathon in the 12 months prior to the claim, or (b) AUD $100.

15. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any conduct that we believe violates these Terms or is harmful to other users or Fundathon.

16. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated via the app or by email. Continued use of the Service after changes means you accept the updated Terms.

17. Governing Law

These Terms are governed by the laws of Queensland, Australia. You agree to submit to the exclusive jurisdiction of the courts located in Brisbane, Queensland for any disputes arising from these Terms.
